(NECN) - A New York restaurant owner, who witnessed the fatal police shooting of a college football player from Massachusetts, is speaking out.

The man says Danroy Henry came to a near stop when a police officer stepped in front of his car last fall. However, he says Henry then sped up and struck the officer, knocking him on the hood.

Officer Aaron Hess then fatally shot the 20-year-old Henry.

The restaurant owner testified before a grand jury investigating Henry's death.

The grand jury later cleared police of any wrongdoing. The Justice Department is reviewing the case.
