(NECN) - As Dzhokhar Tsarnaev's condition improves and the FBI continues their investigation - NECN takes a look at the latest legal developments in the case with NECN Legal Analyst Randy Chapman.

Chapman talks about the upcoming trial for Tsarnaev and the push to acquire the death penalty.

He says that Tsarnaev probably will not be making any more statements without a lawyer present, but that he should be getting a fair trial in Massachusetts.

He says that it was his brother that seemed to be the mastermind behind the situation and that it may mitigate some of Dzhokhar’s responsibility and change the course of the trial.
