Labor Law and Market Basket Protests

Attorney Richard Glovsky weighs in on the unfolding drama at the regional supermarket chain

Eight supervisory employees of Market Basket were fired over the weekend for protesting for ousted CEO Arthur T. Demoulas' return.

Demoulas released his first statement since his firing on Monday night, saying that workers shouldn't be punished for their dedication. He also said the company's success is because of its business model, and its "impassioned" team of workers.

"This is not about me," he said.

Labor law expert Richard Glovsky says the employees may have some recourse based on a number of factors.

"First off, companies have policies and companies with policies mroe and more are being held by courts to be bound by those policies ... even if they have no contract with the employee," he said.

Glovsky points out cases where employers disregard the policies they've set forth when firing someone, such as giving the terminated employee a chance to be heard.

"Then the employees litigate the matter and they are winning those more and more," he said.
