(NECN) - A photo has come back to haunt the defendant in a drunk driving crash in Rhode Island.
Joshua Lipton was charged in October 2006 crash that seriously injured a woman.
Two weeks later, Lipton attended a Halloween party wearing an orange jump suit labeled "Jail Bird."
Someone took a picture and posted in on Facebook.
The prosecutor got a hold of it and used it to portray Lipton as a unrepentant partier who lived it up while his victim recovered in the hospital.
The judge agreed and sentence Lipton to two years in prison.
