NECN TV Diner Gala Smart-Car November 15, 2008 Giveaway Rules:
1. New England Cable News (NECN) is presenting the TV Diner Platinum Plate Gala on November 15, 2008 at Herb Chambers Lexus showroom on Route 1 in Sharon Massachusetts. Anyone, with the exception of those who are excluded by these rules, who purchases a ticket to attend the TV Diner Gala to be held on November 15, 2008 at Herb Chambers Lexus in Sharon Massachusetts and who attends the Gala, shall be eligible for entry in the 2008 smartcar giveaway during the event. NO OTHER PURCHASES ARE NECESSARY. Void where prohibited. Tickets will go on sale on Saturday, Sept. 20, 2008 limited in number and sold on a “first come first served” basis. By purchasing a ticket to the event affording the purchaser entry into the drawing, entrants agree to waive any right to claim any ambiguity or error in these Official Rules, or the drawing itself, and agree to be bound by these Official Rules and by all decisions of NECN, whose decisions are binding and final.
2. Eligibility. The contest is open only to legal U.S. residents who are 18 years of age or older as of the date of the contest, and is void wherever prohibited or restricted by applicable federal or state laws and regulations. Employees of the Sponsor, the station NECN their respective parent companies, subsidiaries, affiliates, officers, directors, agents, employees, advertising and promotion agencies and members of their immediate families (spouses, parents, children, and siblings and their spouses) and employees of Herb Chambers are not eligible.
3. How to Enter. You may enter by purchasing a ticket to THE TV DINER PLATINUM PLATE GALA, to be held Saturday November 15, 2008 from 7pm to 11pm at the new Herb Chambers Lexus, Rt 1, The Automile, Sharon, Massachusetts. Tickets may be obtained by purchasing them through ACE Tickets at 1-800-MY-SEATS or on www.aceticket.com. You must attend the event with your ticket to be able to win the car. Lost tickets will eliminate eligibility. Neither the Sponsor, the television stations listed above nor their respective parent companies, subsidiaries, affiliates, officers, directors, agents and employees are responsible for tickets that are stolen or damaged.
4. Selection of Winners. Winners will be selected during the November 15 event through a random drawing by employees of the station. The odds of winning depend on the number of eligible entries received. The Winner will be required to sign and return to the Sponsor an affidavit of eligibility and liability and publicity release within 2 days of the event.
5. Prizes. The smartcar is valued at approximately $15,000. The prize cannot be exchanged for cash. Transfer of the prize is prohibited. All taxes and all other expenses, costs or fees associated with the acceptance and/or use of the prize are the sole responsibility of the winner. Winner must complete an affidavit of eligibility and liability release, or the prize will be forfeited and alternate winner selected. NECN and its affiliates and employees are not responsible for any damages or injuries sustained through use of the smartcar by the winner.
6. Disclaimer. Winner assumes all liability for any injury or damages caused or claimed to be caused by his or her participation in the CONTEST and/or the acceptance and/or use of the prize, and releases the NECN, and its respective parent companies, affiliates, officers, directors, agents, and employees, from any such liability NECN, and its respective parent companies, subsidiaries, affiliates, officers, directors, agents and employees are not responsible for technical problems with the vehicle. Entry constitutes permission (except where prohibited by law) to use winner's name, city, state, likeness and/or voice for purposes of advertising, promotion and publicity without additional compensation. The winners' names and city of residence will be posted online and mailed to those who request it.
RELEASE AND INDEMNIFICATION: BY ENTERING, ENTRANTS RELEASE AND HOLD HARMLESS NECN FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE GIVAWAY OR PARTICIPATION IN ANY GIVAWAY-RELATED ACTIVITY. THIS INCLUDES ANY DAMAGES RESULTING DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE VEHICLE AWARDED IN CONNECTION WITH THEGIVEAWAY, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY. LIMITATION OF LIABILITY: IN NO EVENT WILL THE NECN BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF ANY ACCESS TO AND/OR USE OF THE GALA SITE.
