Keene, NH Jury Unable to Reach Decision in Quadruple Fatal 89 Fire

KEENE, N.H. (AP) - A judge has declared a mistrial in the murder case against a man accused of setting a 1989 fire that killed a New Hampshire family of four.

The jury was unable to reach a unanimous decision Thursday in David McLeod's case.

McLeod was charged with four counts of second-degree murder in the deaths of Carl and Lori Hina, their 4-month-old daughter, Lillian, and Carl Hina's 12-year-old daughter, Sara.

Prosecutors say McLeod had threatened to set fire to the apartment house where his ex-girlfriend lived and was jubilant during and after the fire, until he learned of the deaths. A lawyer for the 57-year-old McLeod argued his cruel statements don't prove his guilt.

Judge John Kissinger refused to grant McLeod bail but said a retrial would have to be scheduled soon.
