Denied a Job For Being Gay? Hearing Held in Case of Mass. Man Vs. Catholic School

It is likely this case will end up in the state supreme judicial court

Matthew Barrett broke down in tears after a hearing about whether a local prep school was legally allowed to deny him employment solely because he's gay.

Barrett was offered a job as a food services manager at Fontbonne Academy in Milton and gladly accepted. But when the school learned he's married to a man, they took it back.

Fontbonne is a Roman Catholic School for girls and its lawyer argues Barrett's presence contradicts their teachings.

The lawyer argued that state law allows religious institutions the right to make employment decisions based on their doctrine.

But Barrett's lawyer argued that since Fontbonne allows students from all faiths, that exemption to the discrimination law doesn't apply.

Fontbonne released a statement saying, "Fontbonne offers an open and inclusive environment for all of our students and does not discriminate based on sex or sexual orientation."

It is likely this case will end up in the state supreme judicial court.
