Boston police are looking to bring criminal charges against one of Massachusetts' most ardent advocates of the legalization of marijuana.
The Boston Globe reports a magistrate judge will decide Tuesday whether or not to approve a complaint filed by the Boston Police Department against 57-year-old Bill Downing.
The complaint seeks to bring multiple charges of distribution of a Class C substance as well as marijuana against the Reading resident.
Police say Downing is using medical marijuana laws to hide his illegal sale of marijuana "and its extracted by-products."
Downing's attorney, John Swomley, says the complaint is an attempt to "silence the most vocal supporter of the legalization of marijuana."
A police spokesperson couldn't be reached for comment Monday night.
Swomley says he will contest the charges.
