A state appeals court has ruled that a New Hampshire man cleared of murder in the 1969 slaying of a 15-year-old Massachusetts boy can still be tried for perjury.
The Sun reports that Judge Richard Tucker had dismissed the perjury charge against 63-year-old Michael Ferreira of Salem, New Hampshire in 2013.
Tucker ruled that the 2012 verdict finding Ferreira not guilty of murder in the death of John McCabe indicates the jury didn't find co-defendant Edward Brown's testimony credible.
The appeals court ruled Friday that the perjury charges don't hinge on Brown's credibility. The court says the charges alleged Ferreira "falsely denied having any knowledge of what happened to McCabe.''
Ferreira's attorneys have the option to appeal the newest decision to the state Supreme Judicial Court.
