A 27-year-old Congolese man convicted of sexually assaulting a Burlington, Vermont, student is facing deportation.

    The Burlington Free Press reports
a judge handed a new sentence to Yetha Lumumba on Tuesday after the state Supreme Court ruled he cannot face deportation with his original 8-years-to-life prison sentence. They said the sentence was cruel and unusual.

Lumumba was a University of Vermont student. He was convicted of sexually assaulting a classmate in June 2010.

Lumumba has now been ordered to serve six years and nine months in prison. His lawyer says Lumumba is slated to be released from prison in 2017. He will then be deported back to the Congo.

Lumumba apologized for the circumstances of the case. He is incarcerated at the Northern State Correctional Facility in Newport.
