Woman Charged in Deadly New Hampshire Bike Crash Challenges Bloodwork

Darriean Hess' lawyers say withdrawing blood without a warrant or consent is illegal search and seizure

Lawyers for an unlicensed New Hampshire driver charged with driving into a group of bicyclists, killing two of them, are seeking to suppress blood samples from evidence in her upcoming trial.

Police said 20-year-old Darriean Hess of Seabrook was driving last September without a license, speeding and under the influence of drugs when she ran into the bicyclists in Portsmouth. Two were killed.

Foster's Daily Democrat reports Hess' lawyers said she didn't want medical treatment, but was taken to a hospital, where four tubes of blood were drawn. Tests showed Hess had ingested several drugs.

The attorneys said withdrawing blood without a warrant or consent is an illegal search and seizure and Hess didn't sufficiently understand the consequences of her actions.

A hearing has been scheduled for Oct. 6.
