Wrongful Death Lawsuit Filed in Fatal Pizza Shop Crash in Newton, Mass.

A wrongful death lawsuit has been filed by the husband of a woman killed after an SUV plowed into a popular Newton, Massachusetts pizza shop earlier this year.

The crash last March at Sweet Tomatoes killed Eleanor Miele as well as Gregory Morin. 

George Miele, Eleanor Miele's husband, is suing the driver, Bradford Casler. According to the suit, he is seeking damages to compensate him for the wrongful death of his wife, damage to the estate, funeral expenses and conscious pain and suffering.

The suit claims Eleanor Miele's death was the result of Casler's "malicious, willful, wanton and/or reckless conduct" or gross negligence.

Police said Casler slammed into cars before crashing into the pizza shop. He has pleaded not guilty to criminal charges.
