Father of Patric McCarthy Continues to Fight for Answers

(NECN: Josh Brogadir, Bourne, Mass.) - New Hampshire's U.S. Attorney has ruled that there was no foul play in the death of a Massachusetts boy.

10-year-old Patric McCarthy went missing in the White Mountains during a family vacation in 2003. His body was later found. To this day, Patric's parents maintain his son was suffocated.

This father is sure his son was murdered despite New Hampshire law enforcement's insistence he was not.

And for now, the case is closed.

"This was no accident, maybe the kid didn't mean to kill him, but that's what he did," Steve McCarthy said.

In spite of the pleadings, the insistence, the frustration, and the anger - the final ruling of his son Patric McCarthy's death was an accident according to New Hampshire U.S. Attorney John Kacavas.

The boy's father says he was murdered.

"He was suffocated and then he was carried up that mountain that's what happened to him, simple. There's a killer out there and they don't even care," McCarthy said.

The 10 year old boy went missing on October 13, 2003 in Lincoln, New Hampshire.

Four days later, after an exhaustive search, his body was found on Whaleback Mountain, 2500 feet in elevation, two miles from his father's condo.

The medical examiner ruled the cause of death "accidental due to hypothermia."

Terry O'Connell, an attorney hired by the McCarthy family disputes the finding, saying he identified three former family members, who he says are to blame.

One of them is Steve McCarthy's former stepson Gabe Fritz, who was 12 years old at the time.

"He admitted to doing it, his brother said he saw him do it and I'm supposed to just let it go? That's not happening," Steve McCarthy said.

The U.S. Attorney said there is no evidence of foul play, telling the Associated Press the work by O'Connell was "reckless" and "shoddy."

A months long independent investigation ruled out suffocation.

Back in the family's Bourne, Massachusetts home where Steve pointed out the last time he was photographed with his son, the memories of the boy are everywhere and the father's hope that justice will be done.

"The cover up just keeps going higher and higher. I hope to find out when it's going to stop," McCarthy added.

Steve McCarthy, at this point, just wants to have a grand jury convened so they'll take a closer look at this case.

He says the US Attorney in Boston wanted to take a look, but it was denied because it was the jurisdiction of New Hampshire.
