Brother of Biker Killed by Garbage Truck Files Wrongful Death Suit

The lawsuit says the three companies were negligent in forcing 64-year-old Margaret Rugg "into a narrow, unsafe area"

The brother of a woman killed by a garbage truck while she was biking in a construction zone in Exeter, New Hampshire, has filed a wrongful death suit on her behalf.

The Portsmouth Herald reports James Rugg filed the suit on Dec. 21 in Rockingham Superior Court against Pinard Waste Systems of Hooksett, Martini Northern of Portsmouth and Bourassa Construction of Stratham.

The lawsuit says the three companies were negligent in forcing 64-year-old Margaret Rugg "into a narrow, unsafe area" on Epping Road that resulted in her death on July 22.

Margaret Rugg was biking when she lost her balance and was run over by the back wheels of a commercial trash hauling truck.

Attempts to reach Pinard and Bourassa were unsuccessful. A spokesman for Martini Northern declined to comment.
