Grand Jury to Hear Cases of 3 Charged After N.H. Teen's Death

The cases against a mother and two others charged in connection with the drug overdose death of her 17-year-old daughter will proceed to a county court, where a grand jury will decide whether to indict them.

Fosters Daily Democrat reports a judge ruled Monday there was probable cause to charge 31-year-old Leslie Aberle of Salisbury, Massachusetts, with dispensing a controlled drug resulting in death. She's also been charged with conspiracy to commit possession of a controlled drug and witness tampering. Her lawyer said the charges were based on hearsay and argued for a bail lower than the $25,000 set. The judge disagreed.

The cases of 41-year-old Jazzmyn Rood, Tarmey's mother, and 41-year-old Mark Ross, also are headed to county court. The judge ruled there was probable cause to charge Rood, who is scheduled for a bail hearing on Wednesday.

Ross, who is represented by a public defender, waived his right to a hearing. He is charged with giving Tarmey a drug that caused her death, as well as witness tampering, falsifying physical evidence and conspiracy to commit possession of a controlled drug

Rood is charged with endangering the welfare of a child, reckless conduct and conspiracy to possess a controlled drug. Her lawyer had argued Rood's decision to leave the motel room while her daughter snorted heroin wasn't reckless behavior.

In court Monday, Rochester Police Detective Christopher Mangum testified Ross said that he, Aberle and Tarmey had driven to Methuen, Massachusetts, to buy heroin while Tarmey had planned to meet up with her boyfriend, but he didn't show.

Mangum testified that Ross said the three returned to the motel, and he and Aberle injected themselves with heroin before he injected Rood. Ross told Mangum Tarmey was upset about not seeing her boyfriend, and that Aberle gave Ross some heroin "to shut her up." He said Tarmey took the drug, he fell asleep, and later awoke to find her dead.
