The families of two men killed in a Biddeford, Maine, fire are filing a wrongful death lawsuit against the building's owner.

Twenty-three-year-old Michael Moore died of smoke inhalation in the September fire. His friend, 21-year-old James Ford, died a month later from complications. A grand jury later indicted Dylan Collins of Biddeford on charges of depraved indifference murder and arson.

The families of Moore and Ford filed their lawsuit against building owner Nielsen Clark on May 28. Clark's lawsuit, Gregory Clayton of Camden, declined to comment. The lawsuit says the building wasn't up to safety codes.

Police say Collins, 18 at the time of the fire, told them before his arrest in November that a 16-year-old girl who lived in the building had broken up with him months prior.
