Prosecutors Drop Rape Charge Against Man

Prosecutors are dropping a rape charge against a western Massachusetts man.

The Berkshire Eagle reports 28-year-old Dominique Moody of Pittsfield was accused of forcing a woman onto a bed and threatening to kill her before allegedly raping her in June.

Prosecutors said the woman called police, who found Moody naked and asleep. Moody denied the charges and said the sex was consensual.

Prosecutors filed a motion to drop the rape charge in July. Assistant Berkshire District Attorney Dana Parsons said Monday she could not discuss why the state chose not to pursue the rape charge.

Moody's attorney has filed a motion to compel the state to produce evidence it may have that could exonerate Moody of the remaining charge.

He is due in court on Aug. 24.
