Tsarnaev Jury Headed to Court for Penalty Phase Instructions

The judge will review the schedule for the second phase of the trial, scheduled to begin on April 21

Jurors in the federal death penalty trial of Boston Marathon bomber Dzhokhar Tsarnaev are returning to court so the judge can review the schedule for the second phase of the trial.

The jurors will be back in court Tuesday.

Tsarnaev was convicted of all 30 counts against him in the deadly 2013 attack. During the next phase, the same jury will be asked to decide if he is sentenced to life in prison or the death penalty.

The penalty phase is set to begin April 21. The judge said the break between Tsarnaev's conviction and the penalty phase is based on a request from Tsarnaev's lawyers.

The delay means there will be no testimony on April 15, the second anniversary of the bombing, or on April 20, this year's race.
