Mom Convicted of Strangling Daughter, 8, Wants New Trial

A Rhode Island woman convicted of murder for strangling her 8-year-old daughter after she refused to take a bath is seeking a new trial.

A lawyer for 42-year-old Kimberly Fry, of North Kingstown, argued to the state Supreme Court on Wednesday that the jury should have taken into account whether she was mentally ill or under the influence of drugs when she killed her daughter, Camden, in August 2009.

Her attorney says Fry swallowed pills and the trial judge never informed the jury about a possible involuntary manslaughter finding due to the effect of the drugs.

Prosecutors say the option was never given since the effect of the drugs could not be proven.

Fry was found guilty of second-degree murder in 2011 and sentenced to 20 years in prison.
