Attorneys for a man facing the federal death penalty for killing a Rutland, Vermont, supermarket worker say they may investigate whether their client is "intellectually disabled" and therefore not eligible to be put to death.
The comments came Friday during a hearing in the case of Donald Fell, who was convicted and sentenced to death a decade ago for the 2000 killing of Terry King, of North Clarendon, who was abducted when she arrived for work and later killed.
Fell did not attend the hearing.
Last year, a federal judge ordered a new trial for Fell after it was revealed that a juror in the original case had investigated the case on his own.
Attorneys say they remain committed to being ready for trial in the fall of 2016.
