2 Face Additional Murder Charge After Fatal October Home Invasion in Orange, Mass.

Two people charged with killing a 95-year-old Orange, Massachusetts, man during a home invasion have been indicted by a grand jury for murder in connection with the death of his wife, who succumbed from her injuries a month later.

Joshua Hart, 24, and Brittany Smith, 28, both of Athol, are accused of killing Thomas Harty and seriously injuring his wife during an Oct. 5 home invasion. His wife, 77-year-old Joanna Fisher, died in November.

Prosecutors say the suspects wanted to steal a car and money so they could leave Massachusetts and avoid charges in an unrelated case. They were apprehended in Virginia days after the home invasion.

The combined charges both will face include two counts of murder and two counts of armed robbery, among other charges.

They are expected to be arraigned on the additional murder charge in the coming days.

Both have been held without bail since pleading not guilty at their district court arraignments.
