Prosecutors say they will try a former Vermont state senator for the third time on a charge of sexual assault.

Mynbc5.com reports the Vermont Supreme Court overturned Norm McAllister's sexual assault conviction in November.

The court ruled that a trial court admitted inadmissible evidence, and a trial judge was in error when instructing the jury to disregard unstricken testimony.

Prosecutors say McAllister set up his tenant to have sex with one of his acquaintances instead of paying her electric bill.

[NATL] New Study Says Beards are 'Dirtier' Than Dogs

A recent study suggests that a man's beard contains more germs than a dog's fur. All 18 men's beards studied by researchers at Switzerland's Hirslanden Clinic had higher levels of bacteria in them, compared to only 23 out of 30 dogs. Some beards had so much beard bacteria the men could get sick, the study says.

McAllister has maintained his innocence, and his attorney says he will ask the court to dismiss the charge.

McAllister, a Republican, represented Franklin County in the state Senate when he was arrested in 2015.

He lost his re-election bid in the August 2016 primary.
