A federal judge in Boston has set a date for a hearing on a motion for a new trial for convicted Boston Marathon bomber Dzhokar Tsarnaev.
That hearing is scheduled for Dec. 1 at 10 a.m. in the U.S. District Court in Boston.
Tsarnaev's lawyers say his trial should have been held outside the city because jurors couldn't avoid widespread outrage over the deadly attack.
A filing by his lawyers in August explained their push for a new trial for Tsarnaev, who was sentenced to death.
Tsarnaev was convicted earlier this year and sentenced to death in the 2013 bombing that killed three people and injured more than 260.
During the trial, his lawyers acknowledged he and his brother carried out the double bombing, but that his brother was the mastermind. Tamerlan Tsarnaev died after a police shootout.
The brothers also killed MIT policeman Sean Collier in a shootout with authorities.
