Judge Dismisses Lawsuit Filed Over Teen's 2012 Drowning in Lowell

A judge has dismissed a wrongful death lawsuit filed by the family of a teen who drowned in a Massachusetts high school pool.

The Lowell Sun reports that a judge ruled that 17-year-old Eddie Gayyean was trespassing when he entered the pool area, and there is no evidence to support the city engaged in "willful, wanton or reckless conduct."

Gayyean was found dead in the Lowell High School pool in 2012.

His family sued the city for $100,000 in 2015, saying the city failed to maintain locks or keep them engaged at the pool.

The judge in his ruling said Gayyean, who did not know how to swim, should have known about the pool's danger.

Attorney Rachel Brown, who represented the city, says they are pleased with the lawsuit's results.
