Man Wants Charge Dropped in Elderly Woman's Killing

One of three men charged in the killing of a Vermont grandmother wants the court to dismiss a murder charge against him.

Authorities said 34-year-old Keith Baird, Michael Norrie and Richard Fletcher took part in the killing of 78-year-old Mary "Pat" O'Hagan, of Sheffield, during a botched burglary in September 2010.

Norrie and Fletcher pleaded guilty to charges and were sentenced to prison. Baird is currently facing charges of first-degree murder, kidnapping and burglary.

The Caledonian Record reports Baird's attorney says the state is "unable to prove" that Baird killed or had the intent to kill O'Hagan. He filed a motion to dismiss the charge on Jan. 25.

Caledonia County State's Attorney Lisa Warren opposed the motion, saying that Baird demonstrated a disregard for O'Hagan's life.
