Brian Kenny was arrested Wednesday

A North Providence, Rhode Island, man is expected in court Thursday on charges of neglecting his dog to point where it had to be put down.

Brian Kenny was arrested Wednesday, according to necn affiliate WJAR.

Kenny originally told police the dog, named “Moses," was found in a parking lot outside his wife's work and brought the dog home to care for it.

Police and the city's animal control not only found out that the dog was actually Kenny's, but that his wife had moved out months ago.

According to state law, Kenny is only facing a misdemeanor charge.

If convicted, Kenny will face a $50-to-$500 fine and up to eleven months in prison.
