Judge Rules Nebraska Gay Marriage Ban Unconstitutional

A federal judge ruled on Monday that Nebraska's ban on same-sex marriage is unconstitutional, although he put the ruling on hold and the state appealed the ruling, NBC News reported. Judge Joseph F. Bataillon put his own ruling on hold for a week so the state could appeal the decision to the 8th Circuit Court of Appeals, which has yet to issue a ruling on two pending same-sex marriage cases from South Dakota and Arkansas. If Bataillon's ruling goes into effect as slated on March 9 at 8 a.m. local time, Nebraska would become the 38th state to permit marriage for gay couples.
