A judge has disqualified the lawyer for a New Hampshire prep school graduate convicted of sexually assaulting a 15-year-old freshman, saying she wasn't entirely removed from the defense team that she now claims was ineffective. 

Owen Labrie was convicted last year of misdemeanor sex assault charges and a felony charge of using a computer to lure an underage student for sex and was sentenced to a year in jail. He's out on bail pending appeal. 

In her arguments seeking a new trial, Jaye Rancourt said Labrie's team didn't challenge the computer offense until after his trial and conviction.

Rancourt was hired as Labrie's local lawyer; she didn't appear at trial. A judge on Tuesday agreed with prosecutors that she wasn't relieved of her attorney-client relationship obligations.

Labrie was arrested in 2014, days after graduating from St. Paul's School in Concord.
