MBTA Police Make Arrest Under Mass. ‘Upskirting' Law

MBTA Transit Police made an arrest Tuesday night under Massachusetts' new "upskirting" law.

Joshua Gonsalves, 23, of Norwood, appeared in court Wednesday morning. He was released on personal recognizance after his pregnant girlfriend posted his $150 cash bail.

Officers responded to the Forest Hills MBTA station Tuesday night for a report of a man taking pictures up a woman's dress.

The victim told officers that she was standing in the upper busway where she felt something brush against her knees. When she looked down she said she saw a man's hands between her legs with a phone camera pointed upwards.

The suspect then left the area on a bus, but the bus stopped shortly afterward by police at the corner of Washington Street and Garfield Avenue.

Gonsalves has been ordered not to ride the MBTA until further notice.

Gonsalves is due back in court August. 22.

This crime is punishable by up to 2.5 years in jail and up to a $5,000 fine.
