Court Won't Hear Appeal of Man Convicted in Christmas Eve Killing

Jose Lopez had claimed the trial judge overlooked and misinterpreted evidence

The state Supreme Court won't hear the appeal of a Providence man convicted in the 2013 Christmas Eve killing of a rival gang member in Pawtucket.

Jose Lopez had claimed the trial judge overlooked and misinterpreted evidence.

WPRI-TV reports the court affirmed Lopez's murder conviction in a written ruling released this week. It determined the judge hadn't made any error in weighing evidence.

Lopez was sentenced last year to two consecutive life terms for the fatal shooting of 21-year-old Ryan Almeida. The now-19-year-old Lopez was 17 at the time of the killing.

Police said Lopez and two other members of a gang associated with a Providence housing complex were looking to retaliate against the East Side Posse for killing a friend when they ambushed Almeida and Lopez fatally shot him.
