Trooper Charged in DUI Crash Wants Charge Dropped

The Worcester district attorney's office is handling the case to avoid a conflict of interest

The lawyer for a Massachusetts State Police trooper charged with drunken driving and seriously injuring his passenger is asking a judge to dismiss the indictment.

The Eagle reports that Trooper Dale Jenkins' attorney says in his motion that evidence presented to a grand jury that Jenkins was intoxicated is "underwhelming" if not contradictory, and there is no evidence to support that the trooper was speeding or driving recklessly.

Authorities say Jenkins was drunk when he crashed a 1965 Corvette in North Andover in May 2014. He pleaded not guilty and is out on bail.

The Worcester district attorney's office is handling the case to avoid a conflict of interest. A DA's spokesman say a response to the motion hasn't been filed.

The motion is scheduled to be heard April 22.
