The attorneys for accused Boston Marathon bomber Dzhokhar Tsarnaev have filed a motion again asking for a judge to move the trial date to September 2015, arguing that more time is needed to prepare.

Tsarnaev's attorneys suggested in court documents that the current schedule could mean the jury could be debating the death penalty around the second anniversary of the marathon bombing, adding that jury deliberations around the time could lead to emotional publicity and a possible mistrial.

His attorneys also said that any delay would help with their trial preparation, but are hoping for a September 2015 start.

They are also citing Tuesday's decision to delay the Gary Lee Sampson penalty phase re-trial from this February to September as support for their motion to delay.

Tsarnaev is accused of plotting with his deceased older brother, Tamerlan, the 2013 attack at the downtown Boston finish line, which killed three people and injured more than 260.
