A 53-year-old Maine man is dead after he fell from his second-floor apartment balcony while smoking a cigarette.

Portland police say it happened Wednesday afternoon while he was leaning against a balcony railing. It gave way, sending the Portland man into a back yard.

Officials have identified the man as Donald Stain of Portland. Officials say he was alone on the second-floor porch when he fell about 19 feet and landed on an asphault surface.

Records do not show any prior complaints of the porch's condition. City inspectors have ordered that all porches on the building be closed off and inspected.

Police say the death does not appear to be suspicious. The incident remains under investigation.
