A Massachusetts woman found guilty of drunken driving is asking the state's highest court to overturn her conviction, saying she was "sleep driving" after taking a sleeping pill.
Michelle Duggan, a nurse from Maynard, tells the Boston Herald that said she and a friend had a few drinks on June 22, 2012, before heading home. She says she took a sleeping pill, and doesn't remember anything else until police woke her up, half-dressed, in her car, after she crashed into a wall.
She was convicted in 2013. The state Appeals Court upheld the verdict last month.
Now she wants the Supreme Judicial Court to weigh in.
Her lawyer, Mark Helwig, says for a criminal act to occur, there has to be intent, and there was no intent in Duggan's actions.
